We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the features or services you use. The personal information we collect may include the following:

  2. Content You Provide for ServicesSuch as information about the websites or online services you ask us to monitor, test, or gather data from. For example, if you use our Uptime & Performance Monitoring service, you may provide website URLs or identifiers for the services you want monitored; if you use our Web Data Extraction (Scraping-as-a-Service), you may provide target website URLs or specific queries for data to collect; if you use our Load Testing/Stress Testing service, you may provide the target domain or endpoints of your website/API to be tested. We will process such information solely to perform the requested Services and provide you with the results. (Please note: If any data you ask us to collect or process through these Services contains personal information about third parties, you are responsible for ensuring that you have a lawful basis to collect and use such data. UpRock acts as your service provider/data processor for such data and is not responsible for the legality of the content you direct us to collect. You must comply with all applicable data protection laws in relation to any data you obtain through our Services.)

If you choose to connect your social media accounts, we will collect the information described in the section "How do we handle your social logins?" below (such as certain profile information from your social media account). All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

In short: Some information – such as your Internet Protocol (IP) address and/or browser and device characteristics – is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. This data is processed based on our legitimate interest (Art. 6(1)(f) GDPR) in ensuring the security, availability, and performance of our Services.

Like many businesses, we also collect information through cookies and similar technologies. (See "Do we use cookies and other tracking technologies?" below for more details.) The information we collect automatically includes:

  1. Log and Usage DataLog and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services, which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings, and information about your activity in the Services (such as the date/time stamps of your usage, pages and files viewed, searches you conduct, and other actions you take, for example which features you use and for how long), as well as device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  2. Device DataWe collect device data such as information about your computer, phone, tablet, or other devices you use to access the Services. Depending on the device used, this device data may include information like your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
  3. Location DataWe collect location data such as information about your device's location, which can be either precise or imprecise. How much location information we collect depends on the type of device and its settings. For example, we may use GPS and other technologies to collect geolocation data (which can give us your precise location) based on your IP address or mobile device's GPS. You can opt out of allowing us to collect this information at any time either by refusing access (when your device requests your permission) or by disabling the Location setting on your device. However, note that if you choose to opt out, you may not be able to use certain aspects of the Services (for example, location-specific features).

V. How do we process your information?

In short: We process your information to provide, improve, and administer our Services, communicate with you, ensure security and fraud prevention, and comply with law. We may also process your information for other purposes with your consent. We only process your information when we have a valid legal reason to do so. We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  1. To facilitate account creation and authentication, and otherwise manage user accounts. We may process your information so that you can create and log in to your account, as well as to keep your account in working order.
  2. To deliver and facilitate the delivery of services to the user. We may process your information to provide you with the requested Services.
  3. To provide certain features or functionalities of our platform. We may process your information to enable you to use specific features of the Services. For example, if you use our Uptime & Performance Monitoring tool, we process the target site information you provide in order to check your website's availability from various locations and report back to you. If you use our Web Data Extraction service, we process the instructions and target URLs you give us in order to collect and return the requested public data to you. If you use our Load Testing service, we process the target endpoints and related data to simulate traffic and provide you with performance results. We use any such data strictly to perform the service you have requested.
  4. To respond to user inquiries and offer support to users. We may process your information to respond to your inquiries, assist with issues you might be experiencing, and resolve any problems you report with the requested service.
  5. To send administrative information to you. We may process your information to send you details and updates about our products and Services, changes to our terms, conditions, and policies, and other similar information.
  6. To enable user-to-user communications. If you choose to use a feature of our Services that allows communication with another user, we may process your information to facilitate user-to-user communications with your consent.
  7. To request feedback. We may process your information when necessary to request feedback and to contact you about your experience with our Services.
  8. To send you marketing and promotional communications. We may process the personal information you send to us for marketing purposes, if this is in accordance with your marketing preferences. For example, with your consent (or as otherwise permitted by applicable law), we may use your email address to send you newsletters, new product updates, and special offers. VI. Data Processing for Web Scraping and Similar Services

When you use our Services to collect or process data from websites or other online sources (including but not limited to through Web Data Extraction, Uptime Monitoring, or Load Testing), you act as the data controller, and UpRock acts as your data processor under applicable data protection laws such as GDPR.

You are solely responsible for ensuring that any data you instruct us to collect or process using our technical infrastructure is processed lawfully and in compliance with all applicable laws, including data protection and intellectual property laws. This includes (where applicable) obtaining necessary consents or demonstrating a valid legal basis for the collection or use of any personal data obtained via scraping.

UpRock does not inspect, modify, or determine the purpose of the data processed through our infrastructure. We act solely on your instructions, as required to provide the requested Services. If you require a specific data processing agreement (DPA), please contact us at privacy@uprock.ai.

VII. Processing of Data via Client-Side Services

Some of the Services we provide — such as Uptime & Performance Monitoring, Web Data Extraction (Scraping-as-a-Service), and Load Testing — may involve the technical collection, transmission, or handling of data that originates from websites, APIs, or online platforms specified by you, the Client. While these Services are designed to process publicly available or non-personal technical data, we cannot control the nature of the data that may be retrieved from third-party systems.

It is your sole responsibility as the Client to ensure that any data you request to be collected, tested, or monitored using our Services is processed lawfully and in accordance with applicable data protection legislation. We do not inspect, access, or analyze the substantive content of the data you direct our software to interact with. We merely provide the underlying infrastructure to carry out the technical operations at your direction. Accordingly, UpRock acts as a processor (or sub-processor) with respect to such operations, and we disclaim any liability for the legality, accuracy, or use of the content or data targets you define via our Services.

VIII. When do we act as a Controller vs. Processor?

UpRock acts as a data controller when it determines the purposes and means of processing your personal data, such as when you create an account, communicate with us, or use features of the Site. UpRock acts as a data processor (or sub-processor) when we provide Services on your behalf — for example, when you direct us to monitor or extract data from specific websites using our tools. In these cases, you determine the purpose and means of processing, and UpRock processes data solely under your instructions.

IX. Do we collect payment information?

In short: We do not collect or store your payment information. All payments are securely processed by our third-party partner, Stripe.

When you make a purchase through our Services, we do not directly collect or store your payment card details. Instead, all payment transactions are handled by our trusted payment processor, Stripe, which collects your payment data directly through their secure payment platform. Stripe is responsible for processing your payments and storing your payment information in accordance with its own privacy policy. We do not have access to or control over your full payment information (such as credit card numbers), and we rely on Stripe to maintain the security and compliance of all payment data.

XI. When and with whom do we share your personal information?

In short: We may share information in specific situations described in this section and/or with the following categories of third parties.

We may need to share your personal information in the following situations:

  • Vendors, Consultants, and Other Third-Party Service Providers: We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include payment processing, data analysis, email delivery, hosting services, customer service, and marketing efforts.
  • Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Affiliates: We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • Other Users: When you share personal information or otherwise interact with public areas of the Services, such personal information may be viewed by all users and may be publicly made available outside the Services in perpetuity.

In short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice. You can control cookies through your browser settings.

XIII. How do we handle your social logins?

In short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform. We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy policy to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

XIV. Is your information transferred internationally?

In short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in various countries. If you are accessing our Services from outside these countries, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see "When and with whom do we share your personal information?" above), in other countries. If you are a resident in the European Economic Area (EEA) or United Kingdom (UK), then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. However, we will take all necessary measures to protect your personal information in accordance with this privacy policy and applicable law.

XV. How long do we keep your information?

In short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

XVI. Do we collect information from minors?

In short: We do not knowingly collect data from or market to children under 18 years of age. We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. In short: Depending on your location, you may have certain rights regarding your personal information. In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right to:

You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

XX. Account information

If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements.

XXI. Controls for do-not-track features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

XXII. Do California residents have specific rights?

If you are a California resident, you are granted specific rights regarding access to your personal information under California Civil Code Section 1798.83, also known as the "Shine The Light" law. Under this law, if you are a California resident and have an established business relationship with us, you can request information once per calendar year about our sharing of certain categories of personal information with third parties for their direct marketing purposes.

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including:

  • Right to Know: You have the right to request that we disclose certain information to you about our collection and use of your personal information.
