UpRock Acceptable Use Policy

I. Purpose and Scope

This Acceptable Use Policy ("AUP") outlines the rules and restrictions for using UpRock's services (the "Services"). The purpose of this AUP is to ensure that our Services are used safely, lawfully, and in a manner that protects UpRock, our users, and the broader internet community from misuse. By using or accessing UpRock's Services, you agree to comply with this AUP. Any use of the Services for illegal, fraudulent, or abusive activities is strictly prohibited, and we may investigate any suspected violations. This AUP is part of and incorporated into our Terms of Service; if you do not agree with these terms, you must not use the Services.

II. User Responsibilities

  1. AccountabilityYou are responsible for all actions that occur under your UpRock account or via your API keys. This responsibility extends to any use of the Services by your employees, contractors, agents, or any other party you have allowed to access the Services on your behalf. You must ensure that anyone using the Services under your account has read and agrees to abide by this AUP.
  2. Access ControlYou must take reasonable measures to secure your account credentials (user IDs, passwords, API keys, etc.) and prevent unauthorized access. If you fail to protect your access credentials and an unauthorized party misuses the Services through your account, you will be held responsible for that misuse. Notify UpRock immediately if you suspect any unauthorized access to or use of your account.
  3. Compliance with LawsYou are responsible for using the Services in compliance with all applicable laws and regulations as well as our Terms of Service. It is your obligation to determine that your use of the Services (including any data you collect or actions you perform) is legal in the jurisdictions relevant to you and does not violate any third-party rights.
  4. UpRock provides only network and automation services and does not review or vet the legality of content accessed via our platform. You are solely responsible for ensuring that your use of the Services—including any scraping, downloading, or processing of content—complies with all applicable intellectual property and copyright laws. UpRock expressly disclaims any legal responsibility for your copyright compliance.
  5. If you collect or process personal data using UpRock, you must have a valid legal basis and comply with all applicable privacy/data protection laws (e.g., GDPR, CCPA). UpRock is not a data controller with respect to your extracted or processed data; you remain fully responsible for its lawful use.
  6. You may use the Uptime & Performance Monitoring service solely to monitor web services, sites, or systems that you own or are authorized to monitor. You must configure monitors at a reasonable frequency (as offered by your plan) and must not abuse the monitoring network by setting excessively frequent checks or a large number of monitors beyond what is allowed. UpRock may limit or throttle monitoring frequency or volume at its discretion to protect the integrity of the monitoring network ("Swarm") and ensure quality of service for all clients.
  7. Legal and Acceptable UseYou agree to use the Web Data Extraction service only to collect data from websites that you have the legal right to scrape. Many websites have terms of service or legal restrictions on automated scraping. It is your responsibility to review and comply with any third-party website's terms and applicable laws before using our service to extract data from it. You must not use our scraping service to collect:
    1. Personal data or personally identifiable information (PII) from websites in violation of privacy laws or without appropriate authority or consent.
    2. Any data in a manner that infringes intellectual property rights, such as scraping copyrighted content (e.g. images, large text excerpts, databases) where not permitted.
    3. Data from websites where scraping or automated access is expressly forbidden in the site's robots.txt or Terms of Service if such restrictions are legally enforceable. (If you have permission or a legal exception to scrape despite such terms, you must ensure you have documentation of that permission.)
    4. Any content or material that is illegal, offensive, or otherwise violates this Acceptable Use Policy (for example, you may not use scraping to obtain illegal pornography, facilitate fraud, distribute malware, etc.).
  8. Conduct of TestsYou will configure or request the parameters of the test (such as number of simulated users/requests, duration of test, and any specific test script or scenario). UpRock reserves the right to review the parameters and refuse or adjust a test that, in our judgment, could dangerously destabilize the target or our network. We may suggest safer limits if needed. During testing, UpRock's distributed network will generate load according to the agreed scenario. This may involve many devices or agents geographically distributed sending traffic to your system.

III. Prohibited Activities

You must not use UpRock's Services, or allow any third-party to use the Services via your account, to engage in any of the following activities. The examples below are non-exhaustive; any similar activities that are illegal, harmful, or contrary to the intended use of our Services are also prohibited. If you are uncertain whether an activity is allowed, please contact UpRock support for clarification.

  1. Illegal, Harmful, or Infringing Use
    1. Unlawful Content or Behavior: Using the Services to violate any law, regulation, or court order is strictly forbidden. You may not use the Services to transmit, store, or distribute content that is unlawful, fraudulent, threatening, harassing, or defamatory, or that encourages illegal activity.
    2. Intellectual Property Infringement: Do not use the Services to access, collect, download, transmit, or store any material in violation of intellectual property rights or other proprietary rights. This includes content protected by copyright, trademark, trade secret, patent, or any other IP right, unless you have obtained all necessary prior authorization or have a legal right to do so. In short, you are solely responsible for all data and content you retrieve or provide through our Services, and you must ensure you have obtained any required licenses, permissions, or that your use is otherwise permitted by law (for example, under fair use or other exceptions) before accessing or using such material. UpRock does not provide legal advice on what content may be lawfully scraped or used, and we expressly disclaim liability for any copyright or intellectual property violations committed by users of our Services.
    3. You must not use the Services to access, collect, download, transmit, or store any material in violation of intellectual property rights or other proprietary rights. This includes content protected by copyright, trademark, trade secret, patent, or any other IP right, unless you have obtained all necessary prior authorization or have a legal right to do so. UpRock is a network service provider only and does not review, monitor, or provide legal advice regarding your specific use cases or the legality of any data you collect, process, or use through our Services. It is solely your responsibility to ensure you have a reasonable legal license (which may include fair use or other copyright exceptions) for the use of any material you crawl, access, or process via UpRock. We expressly disclaim any responsibility or liability for your copyright compliance and recommend that you consult with qualified legal counsel if you are unsure about your use case.
    4. Privacy and Personal Data: You may not use the Services to violate the privacy or data protection rights of others. This means you should not scrape or collect personal data (such as personally identifiable information) from websites if doing so would breach privacy laws or the website's terms of service. It is your responsibility to ensure you have a lawful basis (e.g. user consent or other legal authorization) for processing any personal data via our platform.
    5. Offensive or Illegal Materials: You are prohibited from using the Services to access or distribute obscene, child sexual abuse material (CSAM), hate speech, or any content that is illegal to possess or distribute. Similarly, you may not use the Services to further any activities that are violent, abusive, or discriminatory, or that advocate harm against any individual or group.
    6. Export Control and Sanctions: Do not use the Services in violation of export control laws or regulations. For example, you may not use, export, or re-export the Services or any data obtained via the Services to any country or individual subject to trade sanctions or embargoes under applicable law. You also may not use the Services to support or facilitate the design, development, or production of weapons (including nuclear, chemical, or biological weapons) or any other activity prohibited by export laws.
  2. Security Violations and Network Abuse
    1. Unauthorized Access ("Hacking"): You must not use the Services to gain unauthorized access to any account, system, network, or data that does not belong to you. This includes attempting to probe, scan, or test the vulnerability of any system or network without the express permission of the owner. Any form of hacking, cracking, or penetration testing against third-party systems without authorization is strictly prohibited.
    2. Interference with Systems: You may not interfere with or disrupt any servers, networks, or internet sites while using our Services. Prohibited activities include any form of denial-of-service (DoS) attack, distributed DoS, mail-bombing, flooding, or deliberately overloading a target. You also may not use our Services to interfere with another user's use of the Services or any other network or service.
    3. Unauthorized Monitoring: You must not use UpRock's monitoring or scraping tools to monitor data or traffic on a network or system without the owner's authorization. In other words, only use our Services on websites, applications, or systems that you own, control, or are lawfully authorized to test or scrape. For example, using our uptime monitoring nodes to check a competitor's site without permission, or using our scraping tools on a third-party website contrary to its terms of use or robots.txt, is not allowed.
    4. Malware and Vulnerabilities: You may not introduce viruses, malware, Trojan horses, spyware, worms, or any other malicious code into any systems or networks via the use of our Services. Also, you may not use the Services to host, transmit, or distribute malware or engage in phishing. Any attempt to exploit security vulnerabilities or to distribute tools for hacking (e.g. keyloggers, exploit kits) through our platform is forbidden.
    5. Evasion and Testing Limits: If you are using our Services for security testing (e.g. load testing or scanning your own systems), you must do so within the bounds of applicable law and your own authorizations. You are not permitted to use UpRock's Services or infrastructure to bypass security measures of any third-party service or website, or to decrypt encrypted materials that you are not authorized to decrypt. Using our Services in any manner that would amount to illegal surveillance or wiretapping is also prohibited.
  3. Load Testing and Stress Testing

    UpRock offers tools to simulate high traffic loads on websites or APIs to test their performance. While this service is valuable for testing your own infrastructure, it carries special responsibilities due to its potential impact. You must adhere to the following rules when conducting load or stress tests:

    1. Authorized Targets Only: You may only run load tests or stress tests against systems and networks that you own, or for which you have explicit, documented permission from the owner. Targeting any system without permission can be equivalent to launching a denial-of-service attack, which is illegal. Before testing a third-party system (e.g. a client's system), ensure you have written authorization. UpRock reserves the right to require proof of authorization for any target you configure in our load testing service.
    2. Accepting Risk of Disruption: You acknowledge that performing stress tests can cause the target system to slow down, become unresponsive, or crash. This is an inherent risk of pushing a system to its limits. By using the load testing Service, you assume all risks related to such disruptions. Plan your tests carefully – for example, schedule them during maintenance windows or off-peak hours – and notify any relevant stakeholders that a test will occur. UpRock is not liable for any downtime, data loss, or other consequences that you or others incur due to a load test you initiate, since those effects are a foreseeable result of stress testing (see also the "Limitation of Liability" in our Terms).
    3. Data Preservation: It is your responsibility to ensure that any critical or sensitive data on the target system is backed up or protected before running a stress test. UpRock will not intentionally alter or destroy your data during testing; however, we cannot guarantee that data (or system state) will remain unaffected under extreme load. You should use sanitized test data whenever possible and avoid pointing tests at production databases containing sensitive information.
    4. No Malicious Overreach: You may not use the load testing Service to attack or overwhelm any network beyond what is necessary for your test on the authorized target. For instance, you should not intentionally use our platform to consume excessive third-party bandwidth or to involve unwilling participants in the test. Any attempts to leverage the load testing service for unintended purposes (e.g., to harass or disrupt unrelated services) are strictly prohibited.
  4. Spam, Fraud, and Malicious Conduct
    1. No Spam or Unsolicited Messaging: You may not use the Services to send unsolicited bulk communications, mass marketing emails, SMS messages, or any form of "spam" to anyone. UpRock's platform is not intended for sending out emails or messages to third parties, and any abuse of our Services to distribute spam or unsolicited advertisements (for example, by scraping contact information and then using UpRock systems to send emails) is forbidden.
    2. No Fraud or Deception: You must not use the Services to engage in fraudulent activities or schemes. This includes activities like identity theft, credit card fraud, pyramid or phishing schemes, or any other conduct intended to defraud individuals or organizations. You may also not use scraped data or our tools in a manner that impersonates or misrepresents your identity (for example, scraping a website and then posing as that website's operator). Any form of impersonation, misrepresentation, or deceit using our Services is prohibited.
    3. Prohibited Technical Abuse: You may not use the Services to carry out attacks on third-party applications or users. For example, using our scraping or automation tools to inundate another website with fake accounts, fake transactions, click fraud, or any automated behavior intended to abuse or game a system is not allowed. Similarly, you may not use our Services to transmit content that contains malware, engages in phishing, or attempts to illegally collect login credentials or personal information from others.
    4. No Network Abuse or Blacklisting: Do not use the Services in a manner that causes our IP addresses, domains, or infrastructure to be blacklisted. For instance, if you are using UpRock's services in ways that generate abuse complaints (e.g., scraping websites at a rate that triggers intrusion detection systems or sending spammy requests), we may suspend your access. You should configure and use the Services responsibly to avoid negative impacts on networks and third-party services. Any activities that disrupt the normal use of networks (such as DNS poisoning, ARP spoofing, etc.) are strictly disallowed.
  5. Fair Use and Platform Integrity
    1. Excessive Use: You must use the Services within the usage limits of your plan and in accordance with our documentation. Do not impose an unreasonable or disproportionately large load on our infrastructure or networks. For example, you may not intentionally consume excessive bandwidth, CPU, or other resources in a manner that is unrelated to the intended use of the Services or that exceeds the limits outlined in your agreement. We reserve the right to throttle or block activities that put undue strain on our systems or adversely affect the performance for other users.
    2. Circumvention of Limits: Any attempt to circumvent or bypass our security measures, authentication mechanisms, usage quotas, or other limitations of the Services is prohibited. This includes creating multiple accounts to exceed usage limits, modifying or spoofing request headers or user agents to evade detection or restrictions, or using any automated means to access the Services in a way that violates our API usage guidelines or Terms of Service.
    3. No Resale or Unauthorized Distribution: You may not resell, rent, or lease the Services to third parties unless you have a specific agreement with UpRock that permits this. Similarly, you may not provide unauthorized third parties with access to the Services, whether for profit or otherwise. Our services and data outputs are for your use (or your authorized end-users' use) only; any commercialization or external distribution of the Services without permission is not allowed.
    4. Integrity of Service: Do not attempt to interfere with the normal operation of UpRock's platform. This means you should not test vulnerabilities or attempt to tamper with UpRock's own systems, reverse engineer our software or protocols (except as permitted by law), inject unauthorized code or content into UpRock systems, or otherwise use the Services in a manner for which they were not intended. Any behavior that could compromise the security or integrity of UpRock's services (or the data of other customers) is strictly forbidden.
    5. Proactive Blocking: UpRock reserves the right to proactively block or filter certain types of content or usage on our platform in order to enforce this AUP and protect our services or others. For example, we may block access via our network to known malicious domains, or prevent scraping of certain websites that have legal or technical blocks, at our discretion. We may do this without notice and without liability for any inconvenience it may cause (we will endeavor to ensure such measures minimally impact legitimate use).

IV. Enforcement and Consequences

Violations of this AUP are taken seriously. If we (in our sole discretion) believe that you have violated this AUP or otherwise engaged in any activity that jeopardizes our platform or other users, we may take action to enforce this Policy. Actions we may take include, but are not limited to:

  1. InvestigationWe may monitor your use of the Services and investigate any suspected violation of this AUP. This could involve reviewing your account activity, audit logs, or any content or data involved. (We will maintain your privacy to the extent possible, but if we detect illegal material or activities, we may have to involve appropriate authorities.)
  2. Cooperation with Law EnforcementUpRock reserves the right to report any activity that we suspect violates any law or regulation to law enforcement officials or other appropriate third parties. We will cooperate with authorities as legally required in any investigation of illegal conduct.
  3. Suspension or TerminationIf we determine that you have violated this AUP, we may suspend or terminate your access to the Services immediately, without prior notice. Suspension may apply to your entire account or just the offending portion of the Services, at our discretion. In serious cases or repeat violations, we may permanently terminate your account and refuse any future use of our Services.
  4. No Refunds for ViolationsIf your account is suspended or terminated due to a breach of this AUP (or other terms), you will not be entitled to a refund or credit for any fees you have paid. UpRock will not be liable for any losses or damages you may incur due to enforcement actions taken for your violations of this Policy.
  5. Removal of ContentWe reserve the right (but do not assume the obligation) to delete or disable any content, data, or materials stored or transmitted via our Services that we find to be in violation of this AUP. For example, if you have data collected through prohibited means or content that is illegal, we may remove or block access to such data.
  6. Legal ActionIn addition to the above, UpRock reserves all rights to pursue any legal remedies available against users who violate this AUP. This could include seeking injunctive relief, damages, and legal fees as applicable. You may also be liable for any costs or expenses incurred by UpRock as a result of your violation, to the extent permitted by law (this includes any costs related to handling abuse incidents, responding to third-party complaints, or damage to our infrastructure).

If you believe your use of the Services has been restricted or your account terminated in error, or if you have resolved any issues that led to a suspension, please contact UpRock support to discuss the matter. We will review any good-faith disputes or requests for reinstatement, but ultimate enforcement decisions lie with UpRock.

V. Updates to this Policy

We may update or modify this Acceptable Use Policy from time to time as our business and the legal landscape evolve. When we make changes, we will post the revised AUP on the UpRock website with an updated effective date. It is your responsibility to review this Policy periodically for changes. If we make significant changes to the AUP, we may also notify users via email or via an in-app notice. The updated AUP will become effective as of the effective date stated in the revision, and your continued use of the Services after that date will constitute acceptance of the changes. If you do not agree with an updated AUP, you must stop using the Services.
